Terms & Conditions for Empower Simcoe’s Fee-For-Service Offerings

 

 

 

Introduction

These Terms and Conditions (“Terms”) govern the provision of fee-for-service offerings “Services”) provided by Empower Simcoe (“Provider”, “we”, “us”, “our”) to you (“Client”, “you”). By registering for any of our Services, you agree to be bound by these Terms, which form a legally binding agreement between you and Empower Simcoe.

Service Registration and Payment

1. Registration: Clients must register for Services through the designated Empower Simcoe platform or contact method. Registration is subject to availability and confirmation by us.
2. Payment: Full payment is required at the time of registration unless otherwise stated. Payments are accepted via the methods specified by Empower Simcoe.
3. Fees: All fees are listed in Canadian dollars. Fees are subject to change at the discretion of Empower Simcoe.

Cancellation and Refunds

• Refer to Empower Simcoe’s specific Refunds Policy for details regarding cancellation and refunds. Generally, refunds are available, minus a 15% administration fee, for cancellations made up to 72 hours before the Service start date. No refunds are provided for cancellations with less than 72 hours’ notice, although a credit may be issued on a case-by-case basis.

Conduct and Participation

1. Expectations: Customers are expected to conduct themselves in a respectful and responsible manner at all times during their participation in Services.
2. Compliance: Customers must comply with all instructions and safety guidelines provided by Empower Simcoe and its staff.
3. Termination: Empower Simcoe reserves the right to terminate a Customer’s participation in a Service for failure to comply with these Terms, including any conduct deemed disruptive or dangerous, without a refund.

Liability and Indemnification

1. Liability: Empower Simcoe will not be liable for any personal injury, loss, damage, or expense arising from or in connection with your participation in Services, except to the extent such liability cannot be excluded by law.
2. Indemnification: You agree to indemnify and hold harmless Empower Simcoe, its officers, employees, and agents, from and against any claims, liabilities, damages, and expenses arising from your participation in Services.

Intellectual Property

All materials provided during the provision of Services, including but not limited to training materials, are the intellectual property of Empower Simcoe or its licensors and are provided for personal use only. Reproduction, distribution, or use of these materials for commercial purposes without express permission is prohibited.

Privacy

Empower Simcoe collects and uses personal information in accordance with its Privacy Policy, available on the Empower Simcoe website. By registering for Services, you consent to such collection and use of your personal information.

Amendments

Empower Simcoe reserves the right to amend these Terms at any time. The most current version of the Terms will be posted on our website and will supersede all previous versions.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without giving effect to any principles of conflicts of law.
